To avoid Dr Zakir Naik in Fiqh issues!

Summary: Dr Zakir Naik is a Da'ii and we give him his due respect for that. He knows himself that he is not an Alim in Deen. Thus Ulema have given their decree that he, not being an Alim in deen, should focus his da'wah to what he is good at (i.e. comparative religion), and leave religious answering to the Fuqaha.

Taqlid - Following an Imam

 

Question:

At our campus several students are actively promoting the ideology that one should only follow the Qur’an and Sunnah, not one of the four Imaams. They especially criticise the Hanafis who do not raise their hands upto the ears before going into ruku, etc. This is causing much confusion. Could you guide us in this aspect.
Answer:
 
It is clear fro
m the question that the impression being given by the promoters of the said ideology is that if you follow one of the four Imaams of Fiqh (Islamic Jurisprudence), you are not following the Qur’an and Sunnah. This is utterly baseless. Understand the fallacy of this argument from the following example: Every citizen of the country is required to obey the laws of the land. Those laws are recorded and available to every citizen. However, a person who wishes to conduct some major business goes to a senior counsel to enquire what legal procedures he will have to follow and what factors he must take into consideration to ensure that he does not contravene any law. He then follows the advice of the senior counsel and conducts his business accordingly. If anybody objects that this person is following the senior counsel and not the law of the land, such an objection will be regarded as extremely foolish and not worth listening to. It is obvious that the person acting according to the advice of the senior counsel is following expert advice about what the law says. In fact, if the businessmen decided to go directly to the law books himself and do what appeared to him to be the correct procedure, he will probably end up making a mess of everything. Thus the proper course is for him to refer to an expert.

MASTERY TESTIFIED TO BY SCHOLARS

 
llah Ta’ala has commanded us to follow those of  knowledge. Those who follow one of the four Imaams of Fiqh have chosen to follow very highly qualified senior counsels and expert jurists who possessed such expertise in Islamic Jurisprudence which all the great scholars of the past 12 centuries have testified to. Imaam Abu Hanifa (R.A.) and Imaam Malik (R.A.) were both Tabiees (those who had seen a Sahabi). Imaam Malik compiled his famous work of Hadith titled Al Mu’atta. Imaam Abu Hanifa (R.A.) compiled a book of Hadith named Kitaabul Athaar. This book was compiled from a collection of 400 000 Ahadith. Imaam Shafi (R.A.) compiled the great work title
d Kitaabul Umm  and other books of jurisprudence. Imaam Ahmad bin Hanbal (R.A.) placed before the world his collection of thousands of Ahadith known as Musnad Ahmad. The world attested to his knowledge and mastery. Apart from their vast knowledge, all the four Imaams were known to be on a very high level of taqwa (piety). Thus those who follow any one of these Imaams can do so with complete confidence. 


TRANSLATE ONE AAYAH

Those who claim that they are following the Qur’an and Sunnah directly should take a moment to ponder over the reality of their claim. The Qur’an and Ahadith are both in Arabic. The overwhelming majority of those who follow this ideology and claim to refer directly to the Qur’an and Sunnah cannot directly translate even one aayah of the Qur’an or one Hadith correctly. How can it ever be imagined that such a person will be able to extract the detailed masaa’il (laws) from the original sources. In reality such people merely follow some novice “lawyer” of this age who claims to extract the masaa’il directly from the Qur’an and Hadith. The expertise of the novice “lawyers” of today is less than a drop in the ocean when compared to the vast knowledge and expertise of the four great Imaams of Fiqh. Almost every single person today who claims to refer directly to the Qur’an and Ahadith, and who has also acquired some knowledge of Deen, still refers to the views of various scholars of the recent past or those of the earlier era, in most masaa’il. Hence while those who make taqleed (follow) one of the four Imaams refer to one great expert, those who claim to go directly to the Qur’an and Sunnah make taqleed of a host of people, many of whom do not remotely compare to the four Imaams.

FABRICATIONS IN FADHAAIL-E-AAMAAL

 

Q: In Fazail Amal you will find that some ahadith have been taken from the book called ’Zailul Aalee’ of Imaam Sooyuti, which means “Tails Of Pearls”, but in the meantime the real name of the book is “Zailul -La’aali-ul-Masnuah fil Ahadethil Maudhoo’ah” which means ’Tails of made up pearls in fabricated ahadeeth\’.
          On the end of the page 21 and in the beginning of the page 22 in the book of Virtues of Salaat, you will find the the words ascribing Kashf of “seeing sins falling down from the limbs of the person performing Wudhu...” to Imaam Aboo Haneefah r.a. Kashf means, in Khandhlawi’s own words “divine manifestation of unseen things”(pg.128 of Virtues of Zikr).
       Muslims know that seeing the unseen(ghaib) is only possible to Allah s.a.w.s., and the claim and lie that ppl are able to do such things is CLEAR SHIRK. And on top of that it is a lie on Imaam Aboo Haneefah r.a.
        There is a hadith on page 142 of Virtues of Zikr, hadith no.28 which in english tells us about Adam a.s. and how he asked forgiveness from Allah when he saw the Prophet\’s s.a.w.s. name on the \’Arsh. Now, if u read the same hadith on the same page in arabic u will find a word MAWDU\’ which we know means fabricated. The same is not translated into english or Urdu for that matter. That is a clear lie on the Prophet s.a.w.s.?

 


A: 1. We definitely agree with the literal translation of the title of that book, but the object of the author was not to mention fabricated Ahaadith only. In fact, he mentions Ahaadith that some Ulama claim to be fabricated and then challenges that ruling. In some instances, he concedes to the verdict of those Ulama and in others he differs and proves the authenticity of these Ahaadith. The proverb is famous, ‘Don’t judge a book by it’s cover!’

2. There is a vast contrast between ‘manifestation of unseen things’ and to have knowledge of the unseen. As mentioned, knowledge of the unseen is only possessed by Allah Ta’ala. This is a fundamental belief of every Muslim and cannot be contested, however, the manifestation of unseen things is different and has taken place time and again from the time of the Sahaaba (Radhiallaahu Anhum) to our day. The angels of Allah are unseen to man, although we believe in their existence. Similarly, we believe that the punishment of the grave is true but it is unseen to us. However, the manifestation of these things were granted to some Sahaaba (Radhiallaahu Anhum), i.e. visibility of the angels for Sayyidatuna Aaisha (Radhiallaahu Anha), Sayyidunaa ibn Abbaas (Radhiallaahu Anhu) and others. The punishment of the grave was heard and manifested for others. See Hayaatus sahaaba vol.3 pgs.777, 841 In the same manner, the washing off of the sins in Wudhu is something we believe in because of the Hadith of Rasulullah (Sallallaahu Alayhi Wasallam) although it is part of the unseen. However, it being part of the unseen does not negate the possibility of it’s manifestation by Allah for anyone of His chosen servants as is the case in the above mentioned examples. The incidents of Sayyiduna Umar (Radhiallaahu Anhu) is quite wellknown – when once while he was in Madinah and his army was in battle in a land away from Madina, Allah made it possible for him to see his army’s position in the battlefields and he was able to command them from his Minbar in Madinah to change their position. (See Dalaailun nubuwwa of Abu Nu’aim and Hayaatus Sahaaba vol.3 pg.808)

In this instance, Allah manifested for Sayyiduna Umar (Radhiallaahu Anhu) what remained unseen to the rest of those that were present in that gathering. So, acts of Kashf have taken place many a time and it’s refutation is a clear result of ignorance.

3. Firstly, just by the word ‘Mawdhoo’ being written in the Arabic commentary does not necessitate that the actual Hadith that was quoted is fabricated. In fact, the author Shaykh Muhammad Zakariyyah cited that ruling (Mawdhoo) in general, in regard to another narration not in regard to Hadith no.28. Anyone with slight knowledge of the Arabic language will understand this from that passage.

Secondly, based on this misunderstanding for one to go further and comment on that particular Hadith (no.28) being ‘a clear lie on the Prophet (Sallallaahu Alayhi Wasallam)’ is baseless and senseless as well. In fact, that Hadith is Hasan (sound), neither weak nor fabricated. See Ra’ul Manaarah pg.248 and al-Raddul muhkamul mateen pg.138.

May Allah Ta’ala save us all from such irrational decision regarding the noble sayings of Rasulullah (Sallallaahu Alayhi Wasallam).

It is not necessary that everything the West does is according to logic. The biggest proof that it is the invention of the west are the song words without which this function is not complete viz. 'Happy birthday to you.' No one says, 'Happy birthday celebration' or 'Happy Blessed birthday' or any other words of this kind. This disease of celebrating birthdays was never prevalent among Muslims before, but since Muslims started living alongside the non-Muslims, they have been influenced by them.

FIRSTLY – That person who has knowledge of Deen and he is aware of it, so seek knowledge from him.

SECONDLY –  That person who has knowledge of Deen but he is unaware of it, so he is sleeping, wake him up.

THIRDLY –     That person who does not possess knowledge and he is aware of his ignorance, so educate him.

FOURTHLY – That person who does not have knowledge and he is not even aware of his ignorance. Such a person is a stupid, so stay far from him.
